Use the power of the tides, the oceans, the waves in clever ways. Use them in a bigger way than any designer has ever put together yet, to power your cities. The largest cities on your planet are on the coasts, and that's where the power source is. Hydro is the answer. It's not dangerous. You've ignored it because it seems harder to engineer and it's not in a controlled environment. Yet, you've chosen to build one of the most complex and dangerous steam engines on Earth - nuclear power.

We also have indicated that all you have to do is dig down deep enough and the planet will give you heat. It's right below the surface, not too far away all the time. You'll have a Gaia steam engine that way, too. There's no danger at all and you don't have to dig that far. All you have to do is heat fluid, and there are some fluids that boil far faster than water. So we say it again and again. Maybe this will show you what's wrong with what you've been doing, and this will turn the attitudes of your science to create something so beautiful and so powerful for your grandchildren. Why do you think you were given the moon? Now you know.

This benevolent Universe gave you an astral body that allows the waters in your ocean to push and pull and push on the most regular schedule of anything you know of. Yet there you sit enjoying just looking at it instead of using it. It could be enormous, free energy forever, ready to be converted when you design the methods of capturing it. It's time. …”

NAM ordered to pay Groningen home owners compensation now

Gas production company NAM has been ordered by judges in Leeuwarden to immediately start compensating home owners in Groningen for the loss of value caused by the earthquakes. 

NAM had said it is only willing to pay the difference once the property has been sold but the appeal court judges agreed with an earlier court ruling which said compensation should be paid now. 

Research bureau Atlas voor Gemeenten said last year that between 2012 and 2017 homes in the earthquake zone in Groningen have fallen in value by an average of 2.2% because the region’s reputation has been damaged. 

The researchers focused their attention on areas in which at least 20% of the homes were damaged by earthquakes and found that homes that were not physically damaged also went down in value. 

Homes in Loppersum, a centre of many of the quakes, lost an average of 8% of their value, while homes in the city of Groningen are now between 0.9% and 2.9% cheaper. 

A foundation representing 4,000 home owners said it now wanted to get round the table with NAM as soon as possible to start fleshing out the compensation deal. ‘Four years after we started legal action, it is about time,’ chairman Lolke Weegenaar told broadcaster NOS.

Jaipur (India) (AFP) - An Indian court has given a woman permission to divorce her husband because their home did not have a toilet, forcing her to seek relief outdoors.

The family court in the northwestern state of Rajasthan ruled on Friday in favour of the woman, who argued that her husband's failure to provide an indoor toilet during their five years of marriage amounted to cruelty.

Justice Rajendra Kumar Sharma said women in villages often endured physical pain waiting until darkness to relieve themselves outdoors.

The judge labelled open defecation -- a major health problem in India -- disgraceful and deemed it torture to deny women a safe environment for relief, the woman's lawyer Rajesh Sharma told AFP.

Divorce is only granted in India if proof such as cruelty, violence or undue financial demands are shown in court.

It is not the first time a marriage has been called off over a toilet.

Last year a woman refused to tie the knot in Uttar Pradesh state after her fiancé refused to build a toilet for the couple.

In June another woman refused to return to the home of her in-laws until they constructed a toilet.

Nearly half of India's population -- almost 600 million people -- defecate in the open, according to UNICEF.

Some 70 percent of Indian households do not have toilets, although 90 percent have access to mobile phones.

Prime Minister Narendra Modi has promised to build a toilet in every home by 2019 in a bid to stamp out open defecation.

The government says 20 million toilets have been constructed since the start of the scheme in 2014.

But experts say open defecation not only stems from poverty but a belief that toilets inside the home are unclean.

Gas company NAM is liable for Groningen earthquake victims’ stress

Gas company NAM is responsible for the ‘immaterial’ damage suffered by people living in the Groningen earthquake zone as well as the actual damage to their homes, judges in Assen said on Wednesday. 

The case was brought by 127 locals who say they have been subject to stress and anxiety because of the damage caused by the earthquakes. Thousands of homes in some parts of the province have been hit by subsidence as the ground settles following the extraction of natural gas. 

Research last year found that only 60% of householders felt safe in their homes after they had suffered quake damage. 

Lawyer Pieter Huitema said after the verdict that he would now be claiming financial compensation at a follow-up case. ‘It could range from €3,000 to €30,000 per person,’ he said. ‘Experts will take a look.’ 

NAM, a joint venture between Shell and ExxonMobil, has already been held responsible for paying for the physical damage to property.

The natural resources of the planet are finite and will not support the continuation of what you've been doing. We've been saying this for a decade. Watch for increased science and increased funding for alternate ways of creating electricity (finally). Watch for the very companies who have the most to lose being the ones who fund it. It is the beginning of a full realization that a change of thinking is at hand. You can take things from Gaia that are energy, instead of physical resources. We speak yet; again about geothermal, about tidal, about wind. Again, we plead with you not to over-engineer this. For one of the things that Human Beings do in a technological age is to over-engineer simple things. Look at nuclear - the most over-engineered and expensive steam engine in existence!

Your current ideas of capturing energy from tidal and wave motion don't have to be technical marvels. Think paddle wheel on a pier with waves, which will create energy in both directions [waves coming and going] tied to a generator that can power dozens of neighborhoods, not full cities. Think simple and decentralize the idea of utilities. The same goes for wind and geothermal. Think of utilities for groups of homes in a cluster. You won't have a grid failure if there is no grid. This is the way of the future, and you'll be more inclined to have it sooner than later if you do this, and it won't cost as much…

Water

We've told you that one of the greatest natural resources of the planet, which is going to shift and change and be mysterious to you, is fresh water. It's going to be the next gold, dear ones. So, we have also given you some hints and examples and again we plead: Even before the potentials of running out of it, learn how to desalinate water in real time without heat. It's there, it's doable, and some already have it in the lab. This will create inexpensive fresh water for the planet. 

There is a change of attitude that is starting to occur. Slowly you're starting to see it and the only thing getting in the way of it are those companies with the big money who currently have the old system. That's starting to change as well. For the big money always wants to invest in what it knows is coming next, but it wants to create what is coming next within the framework of what it has "on the shelf." What is on the shelf is oil, coal, dams, and non-renewable resource usage. It hasn't changed much in the last 100 years, has it? Now you will see a change of free choice. You're going to see decisions made in the boardrooms that would have curled the toes of those two generations ago. Now "the worst thing they could do" might become "the best thing they could do." That, dear ones, is a change of free choice concept. When the thinkers of tomorrow see options that were never options before, that is a shift. That was number four.”

Brazil's Odebrecht, Braskem pay record fine in bribery case

Washington (AFP) - Scandal-plagued Brazilian construction giant Odebrecht and petrochemical affiliate Braskem have agreed to pay a record $3.5 billion to settle a vast international bribery case, US officials said.

Odebrecht, a key player in the Petrobras corruption scandal gripping Brazil, agreed to a fine of $4.5 billion but said it was only able to pay $2.6 billion, the US Justice Department said in a statement. Braskem, meanwhile, will pay $957 million.

The fines are to be paid to Brazilian, Swiss and US authorities, the department said, calling it "the largest-ever global foreign bribery resolution."

It is the latest in a string of terrible headlines for Odebrecht, which Brazilian investigators say was one of the ringleaders of a scheme to plunder billions of dollars from state oil company Petrobras.

Revelation of the scandal has rocked Brazil's political and business establishment to its foundations, with ex-president Luiz Inacio Lula da Silva facing trial and current President Michel Temer reportedly under suspicion.

The bribery case settled Wednesday includes the Petrobras allegations, but is even bigger.

The Odebrecht conglomerate pleaded guilty to bribing government officials and political parties to the tune of $788 million to secure business on three continents -- mostly in Brazil, but also 11 other countries in Latin America and Africa.

"Odebrecht and Braskem used a hidden but fully functioning Odebrecht business unit -- a 'Department of Bribery,' so to speak -- that systematically paid hundreds of millions of dollars to corrupt government officials in countries on three continents," US Deputy Assistant Attorney General Sung-Hee Suh said in a statement.

"Such brazen wrongdoing calls for a strong response from law enforcement, and through a strong effort with our colleagues in Brazil and Switzerland, we have seen just that."

Political fallout

In the main scheme, Odebrecht targeted top Brazilian politicians and executives at Petrobras for more than a decade starting in about 2001. The bribes were used to secure inflated contracts and even get favorable legislation passed in Congress.

Suh praised Brazil's judiciary for tackling the issue head on.

"I cannot praise their efforts enough. They have been under enormous pressure, done an extraordinary job of initiating the investigation and carrying it through," she said.

The Brazilian probe, known by its codename Operation Carwash, has cast dark shadows over two of Brazil's most important companies, Petrobras and Odebrecht, adding to economic pain as the country flounders in deep recession.

Odebrecht's jailed boss Marcelo Odebrecht and 76 other current and former executives have signed plea deals agreeing to tell all in exchange for lighter sentences.

The Brazilian press has described the deal as potentially apocalyptic for the political establishment.

Panama, meanwhile, said it would request information from the United States about alleged Odebrecht bribes paid in Panama to secure contracts, its foreign ministry said.

Shattered record

The previous record bribery settlement was $1.6 billion for German engineering group Siemens in 2008. It settled charges of systematically using bribes and slush funds to land public works contracts around the world.

Margarida Gutierrez, an economist at the Federal University of Rio de Janeiro, told AFP that this settlement, Odebrecht's newest move to come clean, would open the door for its return to the market.

"Right now they are unable to participate in any bids in Brazil or probably out of Brazil," she said. "Now they can start again, and try to clear their name. They will succeed but it will be hard."

The US Justice Department will conduct an "inability to pay analysis" by March 31 to determine the final amount that Odebrecht must come up with. Sentencing has been scheduled for April 17.

Under the plea agreement, Brazil will receive 80 percent of Odebrecht's fines, while the United States and Switzerland will garner 10 percent each.

Braskem, which is traded on the New York Stock Exchange through American Depositary Receipts (ADR), saw its shares soar after the deal was announced, closing up four percent.

It will pay a criminal fine of $632 million, and another $325 million penalty to the US Securities and Exchange Commission.

Under the Braskem deal, Brazil will receive 70 percent of the fines, while US and Swiss authorities receive 15 percent. Sentencing for the firm has not yet been scheduled.

Belated win for coastal protection in Spain

Environmentalists have won a decade-long battle to halt construction of a mega-hotel in one of Spain's largest coastal protected areas. However, the conflict between tourism and conservation is far from over.

It was a clear win for environmentalists when Spain's highest court ruled the construction of a mega-hotel 'illegal'.

Just 14 meters away from El Algarrobico, a pristine beach of Cabo de Gata in southern Spain, the hotel - with its 21 floors and 411 bedrooms - stands vacant.

Its construction in the province of Almeria was dubbed one of Spain's biggest environmental scandals.

The Spanish Supreme Court recently declared the area environmentally protected and has banned construction. Environmentalists have hailed the decision a great success. But, the victory may have come a bit late.

A decade of confusion

"The countdown for the demolition of the Algarrobico's hotel has finally started," said Andalusian environment minister José Fiscal.

His triumphant announcement comes after years of backtracking and legal ambiguity with many locals holding the regional government responsible for the whole fiasco.

It all began in the 1980s, when construction of the hotel was first licensed. Then, the coastal area was not protected. But by the time construction began in 2003, that had changed and building was prohibited.

It wasn’t until 2006 that a local court first ordered an immediate halt to building. But the national environment ministry and the regional government of Andalusia failed to react to the ruling.

Then in 2012, the high court of Andalusia declared the hotel illegal and called for its demolition. But two years later, the court reversed its decision. The hotel was legal and building free to restart.

Now, 10 years after works were halted, Spain's Supreme Court has finally given the green light for its demolition.

The price of the victory

Tearing down the huge edifice will cost an estimated 7 million euros. The national and local government are to split the bill.

There is also the outstanding question of compensation for the hotel’s owners – who are demanding around 70 million euros.

Locals feel they too have lost out financially.

While environmental groups have long fought the hotel, it has always had majority support in the area – mainly for economic reasons.

"Once it was already constructed, it would have been best to make use of it," said Salvador Hernández, mayor of the nearby village of Carboneras.

Hernández argues the hotel would have brought much needed jobs to the village. "Instead, the people – through taxes – will pay for its demolition, and the consequences," he told DW.

Hernández believes the local community has emerged the biggest loser from a debacle that put Carboneras on the map for all the wrong reasons.

"Our village may be outstanding for many reasons, but our image has been destroyed by this scandal," he lamented.

An uncertain future

And the construction that has loomed over Algarrobico for more than a decade will not disappear overnight.

The demolition is expected to produce around 60,000 cubic meters of waste, of which at least 40,000 cubic meters must removed and dumped. The remainder is to be used in the area’s recovery

Greenpeace at least sees an upside to this logistical challenge.

"The demolition work would bring around 400 new jobs," said Pilar Marcos, head of Greenpeace Spain’s coastal campaign.

"98% of the materials could be recycled. Moreover, it represents a new opportunity for sustainable tourism."

What the beach will look like once the process is over remains an open question. Whether it will be restored to its natural state – or become the site for new tourism services has yet to be decided.

According to WWF, tourism is one of the main causes for biodiversity loss in the Mediterranean region. Sea beds, coastal landscapes and marine dynamics are all at risk.

Spain is one of the world’s best-loved tourist destinations. In 2014, it was ranked third in the world for numbers of foreign tourists by the United Nations Tourism Organization.

But threats to environment from tourism are a problem the world over, with Mexico, China, Ecuador, Indonesia and Nepal just a few of countries where vacationers put the landscapes they come to enjoy at risk.

Taiwan developer arrested over quake building collapse

The developer of a Taiwan apartment complex that collapsed during a strong earthquake was arrested Tuesday, as rescuers reported hearing signs of life in the rubble where some 100 people are still trapped.

Prosecutors in the southern city of Tainan launched an investigation into Saturday's disaster after photos showed cans and foam had been used to fill parts of the complex's concrete framework.

The district court took the developer, identified as Lin Ming-hui, and two of his employees into formal custody late Tuesday after they were questioned at the prosecutors' office earlier.

"The court has decided to have all of them be taken into custody on charges of negligence of business duties that caused deaths," Tainan court spokeswoman Kuo Jen-shiow told AFP.

Around 40 people have been confirmed dead and scores are still missing after the collapse of the 16-storey Wei-kuan building. Tuesday's hearing came as the 72-hour "golden window" for finding survivors expired.

It was the only high-rise in the southern city of Tainan to crumble completely when the 6.4 magnitude quake struck before dawn Saturday.

However, Tainan mayor William Lai offered fresh hope of more survivors.

"After detecting signs of life, the rescue team then banged in the direction of the signs three times, and they got a response three times. This shows there's a living person within," the mayor told a press conference.

More than 210 people have already been rescued, including an eight-year-old girl and three others pulled from the rubble Monday.

But hopes were dimming for some relatives of the missing.

"My brother and sister-in-law are trapped in Building A at the bottom of the wreckage. I feel like they've given up on them," Cheng Ya-ling told AFP.

"I'm losing hope and losing faith in the rescue. If there's no miracle and they don't come out alive, I only hope they died quickly and didn't suffer."

"I've been waiting since Saturday in freezing weather at night and I have blankets. How are they going to survive buried down there?" she said.

Distraught relatives repeatedly interrupted the mayor's briefing, complaining they had to wait for information from the media rather than being informed directly.

"I beg you to save us. Our family still has three people trapped inside," one tearful woman shouted at Lai as she broke through cordons and threw herself to the ground.

"We are going to break down," another man complained.

Not giving up

Meanwhile, President Ma Ying-jeou pledged to press on with the rescue operation.

"The government won't give up any one of them. Although the golden 72 hours of rescue has passed, lots of rescue records in the world have beaten it," Ma said while visiting the central emergency operations centre outside Taipei.

The chance of survival rapidly diminishes after the 72-hour window.

Cranes, drills, ladders, sniffer dogs and life detection equipment are being used to locate those buried, with emergency workers and soldiers shoring up the rubble to avoid further collapses.

Taipei mayor Ko Wen-je said the killer quake would speed up urban renewal projects in the capital.

"It would cause huge risks for our citizens should any earthquake of the same scale hit the Taipei area," he told reporters.

While the rescue operation was under way Tuesday, the island was jolted by a 4.9-magnitude quake off the eastern city of Hualien but no damage or casualties were reported.

The weekend quake struck two days before Lunar New Year, when many people would have been visiting relatives for the biggest celebration of the Chinese calendar.

Taiwan lies near the junction of two tectonic plates and is regularly hit by earthquakes.

The island's worst tremor in recent decades was a 7.6 magnitude quake in September 1999 that killed around 2,400 people.

Bangladesh orders mass arrests over 2013 factory disaster

A Bangladesh court Monday ordered the arrest of 24 people and seizure of their assets after they failed to turn up to face murder charges over the collapse of a garment factory that killed more than 1,100 people.

Senior judicial magistrate Mohammad Al Amin issued the warrants after his court accepted the murder charges against the 24 fugitives for the collapse in April 2013 of the Rana Plaza factory compound, one of the world's worst industrial disasters.

"The court accepted the charge sheet against 41 people who have been charged with murder over the Rana Plaza disaster," prosecutor Anwarul Kabir told AFP.

"The court issued arrest warrants against 24 of them as they have absconded. It also ordered the seizure of their property," he said, adding police have been asked to report on their arrests by January 27.

Kabir said the court had accepted the charges against four government factory and building inspectors despite attempts by their departments to shield them from prosecution by citing public servant immunity rules.

The case was delayed by "several months" due to the non-clearance by the various departments, Kabir said, adding that prosecutors now expect the trial to start by April next year.

Among the 41 who have been charged with murder is Sohel Rana, the owner of the nine-storey complex on the outskirts of Dhaka which collapsed on April 24, 2013, at the start of the working day.

Rana, who is in custody awaiting trial, became Bangladesh's public enemy number one after survivors recounted how they were forced to start work despite complaints about cracks developing in the walls the previous day.

At least 1,138 people are known to have died in the tragedy, the worst in the country's history. Rescue workers struggled for weeks to retrieve the bodies from the ruins but several people are still unaccounted for.

More than 2,000 people were injured, including many who lost limbs.

Seven owners of factories housed in the complex and 12 government officials responsible for safety and inspections were also charged with murder.

Workers 'slapped'

Rana's parents, who jointly owned the building with him, and the mayor and councillor of the town of Savar where it was located, were also charged.

Those facing arrest including "associates of Rana" who "slapped and forced" the workers to join the shift, Kabir said.

In a separate case Rana and 41 others have been charged with violating building codes and with illegally extending the six-storey building, which was initially approved as a shopping mall, into a nine-storey factory complex.

The disaster highlighted appalling safety problems in Bangladesh's $30 billion garment industry and triggered global concern as protesters marched to demand action from Western retailers.

A host of such retailers had clothing made at the five factories housed at Rana Plaza, including Italy's Benetton, Spain's Mango and the British low-cost chain Primark.

The disaster prompted sweeping reforms including new safety inspections and higher wages in the industry which employs about four million workers.

Two groups of top retailers such as Walmart and H&M have since launched drives to clean up the sourcing factories. They hired engineers to review fire, building and electrical safety in thousands of garment plants.

Under the clean-up campaign, engineers have identified safety problems in each of the plants, and drawn up recommendations for upgrades as well as setting deadlines for the owners to implement remedial measures.

Top lawyer takes on NAM over Groningen quake dangers

High profile lawyer Gerard Spong has made a formal complaint against gas extraction company NAM, saying he holds it responsible for deliberately damaging houses and other property in Groningen province. 

NAM, a joint venture between Shell and ExxonMobil, is in charge of extracting natural gas from large reserves under the province. Thousands of buildings have been damaged in earthquakes caused by the ground settling after the gas has been removed.

‘NAM has continued to drill in Groningen even though it is well aware of the risks, and has put dozens of lives in danger,’ Spong said. ‘This is a scandal, and the criminal courts should have their say.’ 

Various scientific reports show that the drilling is not only causing material damage but presents a real risk to people living in the province, Spong said. He is representing several private individuals and the lobby group Groninger Bodem Beweging. 

A criminal investigation is necessary because the state has a duty to protect its citizens against danger and injury, the lawyer said.

NAM must compensate quake-hit Groningen home owners, says court

Gas extraction company NAM must compensate home owners in Groningen for the loss of value to their homes because of the earthquakes, whether or not they are up for sale, a court in Assen ruled on Wednesday. 

The court said NAM, a 50:50 joint venture between Shell and ExxonMobil, is responsible for the earthquakes and is therefore liable for the damage. The quakes are caused by the ground settling after the gas has been extracted. 

Local home owners, united in the WAG foundation, say 100,000 homes have been hit by the quake risk and are now worth over €1bn less than they should be. The foundation represents 12 housing corporations and some 900 private owners. 

NAM does pay compensation for visible earthquake damage and accepts house prices have gone down because of the quake risk. However, the company has refused until now to compensation home owners for intangible damage ahead of a sale. 

Values 

The court said the actual drop in values would need to be established at separate hearings and that it estimated property prices have fallen by several percentage points. WAG puts the drop at between 5% and 25%.

‘This is fantastic news,’ WAG’s lawyer Pieter Huitema told news agency ANP. ‘This is a major support to people living in the quake region.’ 

NAM can appeal against the ruling at the High Court in The Hague and the company said it is now considering what steps to take next.

Court Ruling Dries Up Private Water Provision in Jakarta

Jakarta. Two private companies have lost their right to supply water to customers in some parts of Jakarta after a court ruled in favor of a coalition seeking to have water privatization struck down.

PAM Lyonnaise Jaya (Palyja) and Aetra Air Jakarta (Aetra) had their contracts with city-owned water operator PAM Jaya severed by the Central Jakarta District Court on Monday, ending an 18-year partnership.

Jakarta City Council will form a transition team to take over their operations, while Governor Basuki Tjahaja Purnama has said employees of the two companies could possibly find employment with PAM Jaya.

“They are professional workers and we cannot abandon them, we will make preparations so they can work at PAM Jaya,” Basuki was quoted as saying by Tempo.co on Wednesday.

Basuki said he was confident PAM Jaya would be able to manage the capital’s water distribution without Palyja and Aetra.

The court ruling ends a controversial experiment in water privatization in Jakarta, and is a major victory for the Coalition of People Rejecting the Privatization of Water in Jakarta (KMMSAJ), which filed the lawsuit.

The group had argued that the sub-contracted water service was too expensive and many Jakarta residents could not afford it.

The coalition, which includes the Jakarta Legal Aid Fuundation (LBH Jakarta), and are opposed to private ownership of water, also said the service provided by Palyja and Aetra was not up to scratch.

Both Aetra and Palyja have stated that they would file an appeal.

Aetra’s Corporate Secretary Pratama S. Adi said that the company was aware that his company’s contract with PAM Jaya was not favorable to the Jakarta City Council and it was willing to negotiate.

“We have been conducting internal consolidation and next week we will file an appeal,” Pratama said.

Palyja’s spokeswoman Meyritha Maryanie confirmed the company would challenge the ruling.

“During the legal process the contract between Palyja and PAM Jaya is still valid,” Meyritha added.
